These Terms and Conditions ("Terms") govern your access to and use of https://homedesigncare.com (the "Website") and the home renovation, remodeling, and related services ("Services") provided by Home Design Care LLC, a Texas limited liability company with offices at 1200 Main Street, Suite 450, Dallas, TX 75201. By accessing our Website, submitting a quote request, signing a service agreement, or using our Services, you ("you", "your", or "Customer") agree to be bound by these Terms.
By using the Website or our Services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you do not agree to these Terms, you must not use the Website or our Services. We reserve the right to update these Terms at any time; changes are effective upon posting to the Website. Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
Home Design Care provides a wide range of home improvement services including, but not limited to, interior design, exterior renovation, landscaping, home security, fire safety, roofing, solar energy systems, window replacement, flooring installation, bathroom remodeling, and related consultation. All service engagements are subject to a separate written service agreement signed by both parties, which will specify the scope of work, pricing, timelines, warranties, and other project‑specific terms. In the event of a conflict between these Terms and a signed service agreement, the signed service agreement shall control.
Payment schedules are outlined in each service agreement. Typically, a deposit is due upon signing, with progress payments tied to completed milestones and a final payment due upon completion and customer walk‑through. Late payments may accrue interest at the maximum rate permitted by applicable Texas law. We accept major credit cards, checks, ACH transfers, and financing through approved third‑party lenders. Financing approvals are subject to the lender's terms and credit approval.
Home Design Care maintains all required licenses, bonding, and insurance in the states where we operate. We will, where required by law, obtain necessary building permits and schedule inspections for our work. Customer is responsible for providing accurate information about their property, ensuring they are the legal owner or have authorization to perform the requested work, and paying any applicable HOA review fees or municipal permit fees not explicitly included in the contract.
We provide a labor warranty on workmanship for a period specified in your service agreement (ranging from 1 year to lifetime, depending on the service). Manufacturer warranties on materials (including roofing shingles, solar panels, windows, and fixtures) are passed through to the Customer and are subject to each manufacturer's terms. Warranty claims must be reported in writing within the applicable warranty period. Warranties do not cover damage from accidents, misuse, severe weather events, unauthorized repairs, normal wear and tear, or failure to perform recommended maintenance.
Customers may cancel scheduled work by providing written notice at least 72 hours before the scheduled start date for a full refund of any deposit, except where custom materials have already been ordered or permits have been pulled, in which case actual costs incurred will be deducted. Cancellations after work has begun are subject to charges for work completed and materials ordered. We reserve the right to reschedule work due to weather, supply chain delays, or unforeseen site conditions.
All content on the Website, including text, images, graphics, logos, videos, software, and design elements, is the property of Home Design Care or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws. You may view, download, and print pages for personal, non‑commercial use. You may not reproduce, modify, distribute, republish, or exploit any content without our prior written consent.

You agree to indemnify, defend, and hold harmless Home Design Care, its affiliates, officers, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your property, your negligence, or your violation of any law or the rights of a third party.
The Website and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Website will be error‑free, uninterrupted, secure, or free of viruses or other harmful components. Before/after photos and project examples on the Website are representative; individual results may vary based on project scope, structure, and materials selected.
These Terms and any service agreement shall be governed by the laws of the State of Texas, without regard to its conflict‑of‑law principles. Any dispute arising out of or relating to these Terms or our Services shall first be resolved through good‑faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Dallas County, Texas, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
Home Design Care shall not be liable for delays or failures to perform caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, fires, pandemics, labor disputes, supply chain disruptions, government orders, or utility failures.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be reformed to the minimum extent necessary to make it valid and enforceable.
